Introduction and Acceptance

Welcome to RazFit. These Terms of Service ("Terms") govern your access to and use of the RazFit mobile application ("App") and related services (collectively, the "Service").

By downloading, installing, or using RazFit, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

Your use of the Service is also subject to our Privacy Policy, which describes how we collect, use, and protect your personal data.

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms in the App and updating the "Last updated" date.

Definitions

For the purposes of these Terms:

"Service": refers to the RazFit mobile application, website, and all related features and content.
"App": refers to the RazFit mobile application available on the Apple App Store.
"User", "You", "Your": refers to any individual who accesses or uses the Service.
"Subscription": refers to a paid plan that provides access to Premium features of the Service.
"Content": refers to all text, graphics, images, videos, exercises, and other materials available through the Service.
"We", "Us", "Our": refers to RazFit and its operators.

Service Description

RazFit is a fitness application designed for quick and effective workouts. The Service includes:

30 unique bodyweight exercises organized in categories (Upper Body, Lower Body, Full Body)
Customizable workout sessions from 1 to 10 minutes
Calorie tracking and progress statistics
32 unlockable achievement badges
AI-powered personalized training with virtual coaches (Orion and Lyssa)
Multi-language support (English, Spanish, German, Portuguese, French)

Free Features

Basic access to the App includes limited workout sessions and features. Free users may experience restrictions on session duration and available content.

Premium Features

Premium subscribers gain access to extended workouts (up to 10 minutes), unlimited sessions, personalized AI avatars, advanced statistics, the complete badge collection, and an ad-free experience.

The Service is available exclusively on iOS devices (iPhone and iPad) running iOS 18 or later.

Eligibility

You must be at least 16 years old to use the Service. By using RazFit, you represent and warrant that you meet this age requirement.

You must have the legal capacity to enter into a binding agreement in your jurisdiction.

You agree to provide accurate and complete information when creating an account and to keep this information updated.

If you are under 18 years old, you confirm that you have obtained parental or guardian consent to use the Service and accept these Terms.

Account Registration

To access certain features of the Service, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials.

You agree to notify us immediately of any unauthorized use of your account or any other security breach.

Each user may maintain only one active account. Creating multiple accounts may result in termination of all associated accounts.

You are solely responsible for all activities that occur under your account, whether or not authorized by you.

Subscriptions and Payments

RazFit offers the following subscription plans:

Billed weekly with automatic renewal.

Best Value

Annual Plan

€29.99 per year

Billed annually with automatic renewal. Save 81% compared to the weekly plan.

Payment Processing

All payments are processed by Apple through the App Store. By subscribing, you agree to Apple's Terms and Conditions for in-app purchases.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

Prices are shown in Euros (€) but may vary by region based on Apple's pricing matrix. The final price will be displayed before purchase confirmation.

Prices may include applicable taxes depending on your location.

Free Trial

New users may be eligible for a 3-day free trial of Premium features.

During the trial period, you will have full access to all Premium features at no charge.

At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

You may cancel the trial at any time before it ends to avoid being charged. Cancellation must be done through your Apple ID account settings.

Free trial eligibility is limited to one trial per Apple ID. If you have previously used a free trial, you will not be eligible for another.

No payment will be charged during the free trial period.

Cancellation and Renewal

How to Cancel

You may cancel your subscription at any time through your Apple ID account settings:

Open the Settings app on your iPhone or iPad
Tap your name at the top, then tap "Subscriptions"
Select RazFit and tap "Cancel Subscription"

Cancellation must be completed at least 24 hours before the end of the current billing period to prevent renewal.

After cancellation, you will continue to have access to Premium features until the end of your current paid period.

Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel. The renewal charge will be applied to your Apple ID account within 24 hours before the end of the current period.

Cancellation does not entitle you to a refund for any unused portion of the current subscription period, except as required by applicable law.

Right of Withdrawal (EU Users)

If you are a consumer in the European Union, you have the right to withdraw from your purchase within 14 days without giving any reason.

Exception for Digital Content

By starting to use the Service immediately after purchase, you expressly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal once the digital content has been fully provided.

If you cancel during the free trial period, no withdrawal right applies as no payment has been made.

Refund Requests

All refund requests must be submitted through Apple. To request a refund:

Refund decisions are made by Apple in accordance with their refund policy.

License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on compatible iOS devices that you own or control, as permitted by the Apple Media Services Terms and Conditions, including Apple’s Family Sharing feature where applicable.

Restrictions

You agree not to:

Copy, modify, or distribute the App or any Content
Reverse engineer, decompile, or disassemble the App
Rent, lease, lend, sell, or sublicense the App
Use the App for any commercial purpose without authorization
Remove or alter any proprietary notices or labels
Use the App in violation of any applicable law
Attempt to gain unauthorized access to any part of the Service

The license granted is for personal, non-commercial use only.

If you sell or transfer your device to a third party, you must remove the App from the device before doing so. The license does not transfer with the device.

Intellectual Property

RazFit and all Content, features, and functionality of the Service are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

The RazFit name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks. You may not use these marks without our prior written permission.

User Content

Any data or content you submit to the Service (such as workout preferences or favorites) remains your property. By submitting content, you grant us a license to use, store, and process it as necessary to provide the Service.

If you provide feedback, suggestions, or ideas about the Service, we may use them without any obligation to compensate you.

Health and Fitness Disclaimer

IMPORTANT: Please read this section carefully before using RazFit.

RazFit is designed for general fitness purposes only and does not provide medical advice, diagnosis, or treatment. The exercises and workout programs are not intended to substitute for professional medical advice.

Consult a Healthcare Professional

Before starting any exercise program, including RazFit, you should consult with a qualified healthcare professional, especially if you:

Have any pre-existing medical conditions
Are pregnant or nursing
Have cardiovascular disease or risk factors
Have musculoskeletal problems or injuries
Take medication that may affect your ability to exercise
Are over 40 and have been inactive

You are solely responsible for your own health and safety when using RazFit. You assume all risks associated with physical exercise.

Stop exercising immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or any other concerning symptoms.

We are not liable for any injuries, health problems, or other damages that may result from your use of the Service.

Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Nothing in these Terms shall limit or exclude liability that cannot be limited or excluded under applicable consumer protection law.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

Termination

Termination by You

You may stop using the Service at any time by deleting the App and cancelling any active subscription.

Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice, if:

You violate these Terms
You engage in fraudulent or illegal activities
Your use of the Service poses a risk to others or to the Service
We are required to do so by law

Effects of Termination

Upon termination, your right to use the Service will cease immediately. Any provisions of these Terms that should survive termination (such as intellectual property, limitation of liability) will continue to apply.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Spain and the European Union, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Spain, unless you are entitled to bring proceedings in your country of residence under applicable consumer protection law.

Online Dispute Resolution (EU)

If you are a consumer in the European Union, you may use the European Commission's Online Dispute Resolution (ODR) platform to resolve disputes. The platform is available at:

These Terms do not affect any mandatory consumer protection rights you may have under the laws of your country of residence.

General Provisions

These Terms, together with the Privacy Policy, constitute the entire agreement between you and RazFit regarding the Service.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

Except as expressly set forth herein, these Terms do not create any third-party beneficiary rights. Notwithstanding the foregoing, you acknowledge and agree that Apple, Inc. and its subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

Apple Licensed Application End User License Agreement

This section is provided in compliance with Apple’s requirements for applications distributed through the App Store. The terms below supplement (and do not replace) the other sections of these Terms of Service.

Acknowledgement

You acknowledge that these Terms are entered into between you and RazFit only, and not with Apple, Inc. (“Apple”). RazFit, not Apple, is solely responsible for the App and its content. These Terms may not provide for usage rules that are less restrictive than the Apple Media Services Terms and Conditions as of the date you accepted these Terms.

Maintenance and Support

RazFit is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

Warranty

RazFit is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if applicable). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be RazFit’s sole responsibility.

Product Claims

You acknowledge that RazFit, not Apple, is responsible for addressing any claims you or any third party may have relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

Intellectual Property Claims

In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, RazFit, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Export Compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You also agree to comply with all applicable export and import laws and regulations when using the App.

Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the App. For example, your wireless data service agreement may apply when using the App on a mobile device.

Third-Party Beneficiary

You acknowledge and agree that Apple, Inc. and its subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
